1. Acceptance of Terms
Welcome to Tiny Hands. By creating an account or using our mobile application and website (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. These Terms form a legally binding agreement between you and Tiny Hands.
2. Description of Service
Tiny Hands is a parenting companion application that provides tools for tracking pregnancy milestones, baby sleep, feeding, pumping, growth, developmental milestones, daily activities, reminders, and community support. The Service also enables collaboration between co-parents and nannies. The Service is provided on an "as is" and "as available" basis.
3. Account Registration & Responsibilities
To use most features of the Service, you must register for an account. You agree to: • Provide accurate, current, and complete information during registration • Maintain the security of your password and account • Notify us immediately of any unauthorized use of your account • Be responsible for all activities that occur under your account • Be at least 18 years of age (or the age of majority in your jurisdiction) • Not create an account on behalf of another person without their consent We reserve the right to suspend or terminate accounts that violate these Terms.
4. Acceptable Use
You agree not to: • Use the Service for any unlawful purpose or in violation of any law • Post abusive, defamatory, harassing, or hateful content in the community • Impersonate another person or misrepresent your affiliation • Attempt to access another user's data without their consent • Interfere with or disrupt the Service, servers, or networks • Use bots, scrapers, or automated tools to access the Service • Upload viruses, malware, or other malicious code • Share content that infringes on intellectual property rights • Use the Service to provide medical advice or replace professional healthcare Violations may result in content removal, account suspension, or termination.
5. User Content
You retain ownership of all content you submit to the Service, including logs, photos, milestones, community posts, and messages ("User Content"). By submitting User Content, you grant Tiny Hands a non-exclusive, royalty-free license to host, store, use, display, and process your User Content for the purpose of operating the Service. You are solely responsible for your User Content and represent that you have all rights to submit it. You agree not to submit content that violates any law or third-party rights. We reserve the right to remove any content that violates these Terms.
6. Health & Medical Disclaimer
Tiny Hands is a tracking and organizational tool. It is NOT a medical device and does not provide medical advice, diagnosis, or treatment recommendations. The AI-generated insights, tips, and summaries are for informational purposes only and should not replace professional medical advice. Always consult a qualified healthcare provider regarding any medical concerns, including those related to pregnancy, infant care, feeding, sleep, and development. Never disregard professional medical advice or delay seeking it because of something you read in the Service.
7. Collaboration Features
The Service allows you to share data with co-parents, nannies, and other caregivers. You are solely responsible for deciding who to share with and what permissions to grant. Once you share data, the recipient may access it according to the permissions you set. You can revoke access at any time, but we cannot recall data that has already been viewed or exported by a recipient. When inviting a nanny, you are responsible for ensuring they accept the Terms and Conditions presented to them before accessing your data.
8. Intellectual Property
The Service, including its design, features, and software, is owned by Tiny Hands and protected by intellectual property laws. These Terms do not grant you any right to use the Tiny Hands name, logo, or trademarks. All User Content remains the property of the user as described in Section 5.
9. Subscriptions & Fees
The core features of Tiny Hands are currently free. We may introduce paid subscription plans or premium features in the future. Any paid features will be clearly disclosed before purchase, and subscriptions can be managed or canceled through your device's app store settings. Fees are non-refundable except as required by law or the app store's refund policy.
10. Disclaimers
The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, secure, or that results will be accurate or reliable. You use the Service at your own risk. Any reliance on the Service is solely at your own risk.
11. Limitation of Liability
To the maximum extent permitted by law, Tiny Hands and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or goodwill, arising from your use of or inability to use the Service. Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the preceding 12 months (or $50 if you have not made any purchase).
12. Indemnification
You agree to indemnify and hold harmless Tiny Hands and its affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your User Content, your violation of these Terms, or your misuse of the Service.
13. Termination
You may delete your account at any time within the app. We may suspend or terminate your access to the Service at any time, with or without cause or notice, if we believe you have violated these Terms or for any other reason. Upon termination, your right to use the Service ceases, and your data will be deleted as described in our Privacy Policy.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts located in the United States.
15. Changes to These Terms
We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms within the app and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
